Common use of Carry-over and Accumulation of Vacation Days Clause in Contracts

Carry-over and Accumulation of Vacation Days. Vacation is to be used during each contract year; there shall be no carry-over or accumulation of vacation from one contract year to the ensuing contract year. Upon ending employment, unused vacation days will not be paid except to the extent required by law. If payable, unused vacation will be paid at the effective daily rate of pay (per diem based on salary only) at the time each unused vacation day first became available. There shall be no pay for unused vacation days in the event the Board determines that the Superintendent has engaged in misconduct which provides just cause for termination or cancellation.
