Borrower's Affidavit. The Borrower shall have delivered to the Bank the affidavit of the Borrower affirming (among other things) as of the date of each draw, (i) that all costs for labor and material for the construction and equipping of all improvements comprising any part of the Project furnished to the date of Borrower's affidavit have been paid in full (in accordance with Section 5.6 above), and (ii) that no bankruptcy or other insolvency proceedings have been instituted by or against the Borrower.
