If an alternative dispute resolution process is used to resolve a dispute on a matter, the parties to the dispute must genuinely attempt to resolve the dispute using that process. If the either party does not agree to use an alternative dispute resolution process, or if the parties cannot reach agreement on who is to conduct the alternative resolution process, either party may refer the matter to the Australian Industrial Relations Commission for mediation and/or conciliation and, where agreed between the parties, by arbitration.
