ANTI-VIRUS WARRANTY. Software and hardware provided by Supplier under this purchase order shall not contain computer viruses or other malicious software. In fulfilling the terms of this purchase order, Supplier agrees to take precautions to avoid conveying computer viruses or other malicious software to Buyer. Specifically, all computer files, disks, memories or other media provided by Supplier to Buyer (other than third party Supplier software in its original, unopened packaging materials) will be checked by Supplier prior to delivery to Buyer to detect and remove any computer virus or other malicious software. The virus check that is performed by Supplier will include checks with current, up-to-date anti-virus software and any virus problems that are found during the check (or later found by Buyer) will be fixed by Supplier.
ANTI-VIRUS WARRANTY. Flexera represents and warrants to Licensee that it has used industry standard anti-virus software and processes to test the SaaS for viruses, worms, Trojan horses or other harmful, malicious or destructive code and such tests have shown no such viruses, worms, Trojan horses or other harmful, malicious or destructive code.
ANTI-VIRUS WARRANTY. Flexera represents and warrants to Customer that the Products do not contain any known viruses, worms, Trojan horses or other harmful, malicious, or destructive code.
ANTI-VIRUS WARRANTY. Siebel represents and warrants that to the best of its knowledge after employing reasonable technical means to detect computer viruses, the Licensed Software does not contain any virus or other computer software code, routines or hardware components (other than as set forth in the Documentation) designed to disable, damage, impair, or erase the Licensed Software or other software or data. In the event of a breach of this warranty, Distributor's sole and exclusive remedy and Siebel's sole liability shall be to immediately replace all copies of the affected Licensed Software. If Siebel becomes aware of any breach of the Programs to comply with the foregoing Anti-Virus Warranty, Siebel agrees to use its reasonable efforts to notify Customer in writing or by other appropriate means.
ANTI-VIRUS WARRANTY. TOMIA represents and warrants that, to the best of its knowledge, after employing reasonable technical means to detect computer viruses, the Software does not contain any virus or computer software code, routines, or hardware components (other than as set forth in the Documentation) designed to disable, damage, impair, or erase the Software or other data. For failure to comply with this warranty, TOMIA shall replace all copies of the affected Software in the possession of Customer. All costs incurred for replacement of the affected Software including, but not limited to, cost of media, shipping, and deliveries shall be borne by TOMIA. The remedies stated in this Subsection 9.2 are Customer’s sole and exclusive remedies and TOMIA’s entire liability for a breach of this warranty.
ANTI-VIRUS WARRANTY. We warrant that the Program as delivered by Us does not contain any virus software code.
ANTI-VIRUS WARRANTY. The immediate replacement of all copies of the affected Programs in Your possession with copies that do not contain such virus code. If We intentionally breach the warranty contained in Section 7.1.2, You shall additionally have the right to Your proven direct damages, subject to the limitation of liability set forth in Section 8.

ANTI-VIRUS WARRANTY. Siebel represents and warrants that to the best of its knowledge after employing reasonable technical means to detect computer viruses, the Licensed Software does not contain any undocumented lockout devices, timers, time bombs, virus or other computer software code, routines or hardware components (other than as set forth in the Documentation) designed to disable, damage, impair, or erase the Licensed Software or other software or data. In the event of a breach of this warranty, Distributor's sole and exclusive remedy and Siebel's sole liability shall be to immediately replace all copies of the affected Licensed Software.
