Common use of ANTI-VIRUS WARRANTY Clause in Contracts

ANTI-VIRUS WARRANTY. Siebel represents and warrants that to the best of its knowledge after employing reasonable technical means to detect computer viruses, the Licensed Software does not contain any virus or other computer software code, routines or hardware components (other than as set forth in the Documentation) designed to disable, damage, impair, or erase the Licensed Software or other software or data. In the event of a breach of this warranty, Distributor's sole and exclusive remedy and Siebel's sole liability shall be to immediately replace all copies of the affected Licensed Software. If Siebel becomes aware of any breach of the Programs to comply with the foregoing Anti-Virus Warranty, Siebel agrees to use its reasonable efforts to notify Customer in writing or by other appropriate means.
