Additional Mobile Device Requirements. Member understands that Member must, and hereby agrees, at its sole cost and expense, to use a Mobile Device that meets all technical requirements for the proper delivery of Remote Deposit and that fulfills Member’s obligation to obtain and maintain secure access to the Internet. Member understands and agrees it may also incur, and shall pay, any and all expenses related to the use of Remote Deposit in conjunction with a Mobile Device, including, but not limited to, telephone service or Internet service charges. Member is solely responsible for the payment of any and all costs and expenses associated with meeting and maintaining all technical requirements and additional items necessary for the proper use of the Remote Deposit. Member understands and agrees that it is solely responsible for the operation, maintenance and updating of the Mobile Device used in connection with Remote Deposit and the cost thereof, and Member hereby agrees that it will perform, or cause to be performed, all vendor recommended maintenance, repairs, upgrades and replacements. Navigant is not responsible for, and Member hereby releases Navigant from, any and all claims or damages resulting from, or related to, any virus or related problems that may be associated with using electronic mail or the Internet. Navigant is not responsible for, and Member hereby releases Navigant from, any and all claims or damages resulting from, or related to, defects in or malfunctions of the Mobile Device and/or any associated hardware or software, or failures of or interruptions in any electrical, telephone or Internet services. Navigant hereby advises Member, and Member hereby agrees to scan the Mobile Device and/or any associated hardware or software on a regular basis using a reliable virus detection product in order to detect and remove viruses. The virus detection product will not be provided by Navigant.

  • EDD Independent Subrecipient Reporting Requirements Effective January 1, 2001, the County of Orange is required to file in accordance with subdivision (a) of Section 6041A of the Internal Revenue Code for services received from a “service provider” to whom the County pays $600 or more or with whom the County enters into a contract for $600 or more within a single calendar year. The purpose of this reporting requirement is to increase child support collection by helping to locate parents who are delinquent in their child support obligations. The term “service provider” is defined in California Unemployment Insurance Code Section 1088.8, Subparagraph B.2 as “an individual who is not an employee of the service recipient for California purposes and who received compensation or executes a contract for services performed for that service recipient within or without the State.” The term is further defined by the California Employment Development Department to refer specifically to independent Subrecipients. An independent Subrecipient is defined as “an individual who is not an employee of the ... government entity for California purposes and who receives compensation or executes a contract for services performed for that ... government entity either in or outside of California.” The reporting requirement does not apply to corporations, general partnerships, limited liability partnerships, and limited liability companies.   • SPECIALIZED SERVICE REQUIREMENTS In the event that the Participating Entity requires service or specialized performance requirements not addressed in this Contract (such as e- commerce specifications, specialized delivery requirements, or other specifications and requirements), the Participating Entity and the Supplier may enter into a separate, standalone agreement, apart from this Contract.
