Actions Required Following Termination. Upon early termination of the Work, each Party shall be immediately released from any and all obligations to the other Party (except for the obligation of each Party to pay any amount then accrued or due hereunder, or otherwise due under this Article 19), Contractor immediately EXECUTION COPY shall discontinue the Work and remove its personnel and construction equipment from the Site, and except for termination due to Company’s default Company shall be entitled to take exclusive possession of the Materials and all or any part of the Materials delivered or en route to the Site, to the extent that Company has paid Contractor all undisputed amounts hereunder then due and payable from Company to Contractor. Contractor shall immediately take such steps as are reasonably necessary to preserve and protect Work completed and in progress.

Actions Required Following Termination. Upon termination of any Work Authorization, Contractor will (i) immediately discontinue the terminated Work (ii) if applicable, remove from the Site its Personnel and all equipment, waste, rubbish and Hazardous Material brought onto the Site by Contractor or its Subcontractors, and (iii) immediately take such steps as are reasonably necessary to preserve and protect the Work, materials, equipment and supplies at the Site, stored off-site, or in transit.

  • Obligations Following Termination If a Non-Defaulting Party terminates this Agreement pursuant to this Section 13(b), then following such termination, Seller shall, at the sole cost and expense of the Defaulting Party, remove the equipment (except for mounting pads and support structures) constituting the System. Contractor’s assumption of risk of possible non-appropriation is part of the consideration for this Agreement. THIS SECTION CONTROLS AGAINST ANY AND ALL OTHER PROVISIONS OF THIS AGREEMENT.
