Valid Exclusion Request definition

Valid Exclusion Request means a timely-submitted opt-out or exclusion request that satisfies the criteria set forth at Section 11 of this Agreement.
Valid Exclusion Request means a request by a Class Member to opt out of the Settlement that meets the following criteria: (i) is in writing; (ii) states that individual’s current address; (iii) contains the following statement: “I request that I be excluded from the Settlement Class in the case of Xxxxx v. SEIU Healthcare 775NW”; (iv) is signed by the individual; and (v) is mailed to the Settlement Administrator at the address provided in the Notice and postmarked within ninety (90) calendar days after the Initial Mailing Date.
Valid Exclusion Request means a request by a Settlement Class member to opt out of the Settlement that meets the following criteria: (i) is in writing; (ii) states that individual’s current address; (iii) contains the following statement: “I request that I be excluded from the Settlement Class in the case of Valencia v. HDL” (or the Spanish equivalent); (iv) is signed; and (v) is mailed to the address provided in the Notice and postmarked within sixty (60) calendar days after the Initial Mailing Date.

Examples of Valid Exclusion Request in a sentence

  • Class Members who have properly and timely mailed a Valid Exclusion Request, all Class Members will be bound by this Settlement Agreement and the Final Judgment to be entered following the hearing for final approval of the Settlement Agreement.

  • The Valid Exclusion Request must be postmarked on or before the Opt-Out and Objection Deadline specified on the Notice Forms, which is one hundred and thirty (130) days from the date the Court grants the Motion for Preliminary Approval.

More Definitions of Valid Exclusion Request

Valid Exclusion Request means a request by a putative Settlement Class Member to opt out of the Settlement Class that meets the following criteria: (i) is in writing; (ii) states the individual’s current address; (iii) contains the following statement: “I request that I be excluded from the Settlement Class in the case of Renteria v. Stemilt Ag Services LLC.” (or the Spanish equivalent); (iv) is signed; and (v) is mailed to the Settlement Administrator at the address provided in the Notice and postmarked within ninety (90) calendar days after the Initial Notification Date. If the Settlement Administrator receives an opt out request from a putative Settlement Class Member that does not have a postmark or has an illegible postmark, the opt out request will be considered timely if it is received by the Settlement Administrator within seven (7) days of the Notice Deadline.
Valid Exclusion Request means a request by a Class Member to opt out of the Settlement that meets the following criteria: (i) is in writing; (ii) states that individual’s current address; (iii) contains the following statement: “I request that I be excluded from the Settlement Class in the case of Routh v. Related to Valid Exclusion Request

  • Bid Submission Requirement means a task a Prospective Contractor must complete when submitting a bid response. These requirements will be distinguished by using the term “shall” or “must” in the requirement.

  • Information Request means a request for any Information under the FOI Legislation.

  • Mediation Request shall have the meaning set forth in Section 7.2.

  • Registration Request has the meaning set forth in Section 2.01(a).

  • Conversion Request means a request, substantially in the form of Exhibit B, by the Borrower to convert the interest rate basis for all or portions of outstanding Loans, which shall specify (a) the requested Conversion Date, which shall be not fewer than three Business Days after the date of such Conversion Request, (b) the aggregate amount of such Loans, on and after the Conversion Date, which are to bear interest as ABR Loans or Eurodollar Loans and (c) the term of the Interest Periods therefor, if any.

  • Extension Request has the meaning provided in Section 2.20(a).

  • Interconnection Request means a Generation Interconnection Request, a Transmission Interconnection Request and/or an IDR Transfer Agreement.

  • Arbitration Request shall have the meaning set forth in Section 7.3(a).

  • Transaction Request Defined in Section 3.01(a).

  • FOIA notice means a decision notice, enforcement notice and/or an information notice;

  • Service Authorization Request means a Provider’s or Enrollee’s request to the Contractor for the provision of a service.

  • Acceleration Request means a request pursuant to Operating Agreement, Schedule 1, section 1.9.4A, and the parallel provisions of Tariff, Attachment K-Appendix, section 1.9.4A, to accelerate or reschedule a transmission outage scheduled pursuant to Operating Agreement, Schedule 1, section 1.9.2 or Operating Agreement, Schedule 1, section 1.9.4, and the parallel provisions of Tariff, Attachment K-Appendix, section 1.9.2 or Tariff, Attachment K-Appendix, section 1.9.4.

  • Redemption Request has the meaning as set forth in Section 8.1.

  • Reset Notice has the meaning specified in Section 307(b).

  • Objection/Exclusion Deadline means the date by which a written objection to this Settlement Agreement or a request for exclusion submitted by a Person within the Settlement Class must be made, which shall be designated as a date no later than forty-five (45) days after the Notice Date and no sooner than fourteen (14) days after papers supporting the Fee Award are filed with the Court and posted to the settlement website listed in Paragraph 4.1(d), or such other date as ordered by the Court.

  • Surplus Interconnection Request means a request submitted by a Surplus Interconnection Customer, pursuant to Tariff, Attachment RR, to utilize Surplus Interconnection Service within the Transmission System in the PJM Region. A Surplus Interconnection Request is not a New Service Request.

  • Credit Event Resolution Request Date means, with respect to a notice to ISDA requesting that a Credit Derivatives Determinations Committee be convened to resolve:

  • Request for Quotation (RFQ means the solicitation document issued by the DFMDC to potential bidders for the purchase of equipment, supplies, and/or services as described in the document. The definition includes these Terms and Conditions as well as all Pricing Pages, Exhibits, Attachments, and Amendments thereto.

  • Corporation Request and "Corporation Order" mean, respectively, the written request or order signed in the name of the Corporation by its Chairman of the Board of Directors, its Vice Chairman of the Board of Directors, its President or a Vice President, and by its Treasurer, an Assistant Treasurer, its Secretary or an Assistant Secretary, and delivered to the Trustee.

  • Swap Specification means, with respect to any Swap, the Rules or other trading protocols containing specifications for such Swap, as adopted, amended, supplemented or otherwise modified from time to time by BSEF.

  • LIBOR Notice means a written notice in the form of Exhibit L-1.

  • Demand Registration Request shall have the meaning set forth in Section 3.1.1(a).

  • Commercial use request means a re- quest from or on behalf of one who seeks information for a use or purpose that furthers the commercial, trade, or profit interests of the requester or the person on whose behalf the request is made.

  • Denial notice means a board notification denying an application for the issuance or renewal of a license as required by the Act.
