The Developer must enter into a new recordable System Extension Agreement with the Agency regarding Capacity Fees and applicable conditions, but will be credited with the amount of any Capacity Fees previously paid for the parcels involved.
Privately constructed extensions will not be permitted to connect to the District's system unless the work is performed and paid for in accordance with a Water System Extension Agreement.
In unusual circumstances where the provisions of this Section, or any standard agreement previously approved by the Board, appear unreasonable to either party, the Agency and the Developer may by mutual agreement vary said provisions in the System Extension Agreement.

After the additional assets are constructed and the terms of the Water System Extension Agreement are completed to the satisfaction of the District, service shall be provided.
Where this Section says “Developer,” it also refers to any Customer who needs a System Extension Agreement.
