Private Equipment definition

Private Equipment means Equipment not owned, controlled or marketed by UPRR.
Private Equipment means equipment or machinery (including tankers) owned or operated by a private individual or body that may be used to help contain, suppress or reduce the effects of a fire. It does not include equipment or machinery used for the private defense of domestic dwellings in a wildfire; or the equipment or machinery contracted by the fire control agency.
Private Equipment shall be defined as equipment other than General Purpose Equipment as defined above.

  • All determinations of size and mix of the customer’s fleet of Private Equipment are solely and ultimately the responsibility of the customer and are made at the sole risk and expense of customer.

  • Shipper is solely responsible for determining the suitability of the Private Equipment to move the respective lading in issue.

  • NS shall have no responsibility for the failure of Private Equipment to adequately protect the lading where the damage to the lading is not due to any act of NS but to the nature of the Private Equipment.

  • The Motor Carrier may use a Chassis to facilitate movement of Private Equipment only if it has received the prior express approval of UPRR.

  • If equipment used for any shipments tendered by the Customer is owned or leased and provided by, or on behalf of, the Customer, the Customer represents and warrants to the Carrier(s) that such equipment is in compliance with all terms listed in CP’s Tariff 6 [Private Equipment].

  • KCS’s acceptance of Private Equipment at interchange shall not relieve TIH/PIH Customer of its obligations with respect to Private Equipment under this tariff or any other KCS tariff, and shall not constitute a waiver by KCS of TIH/PIH Customer's obligations hereunder.

  • Claims for damaged private equipment as defined in Tariff 6 [Private Equipment] will be adjudicated or governed under the same principles and practices of the current copy of the AAR Interchange Rules for repairs to and settlement of rail equipment.

  • Special mobile equipment means a vehicle not designed for the transportation of persons or

  • Recreational vehicle park means any tract of land used for parking five or more self-contained recreational vehicles and includes any roadway, building, structure, vehicle, or enclosure used or intended for use as part of the park facilities and any tract of land that is subdivided for lease or other contract of the individual lots for the express or implied purpose of placing self-contained recreational vehicles for recreation, vacation, or business purposes.

  • Service Equipment means any equipment, Software, systems, cabling and facilities provided by or on behalf of Verizon and used to facilitate provision of the Services at a Customer Site. Ownership of the Service Equipment does not pass to Customer. Service Equipment does not include Verizon Facilities.

  • Movable equipment means a hand-held or non-hand-held machine or device, powered or unpowered, that is used to do work and is moved within or between work sites.

  • General purpose equipment means equipment, which is not limited to research, medical, scientific or other technical activities. Examples include office equipment and furnishings, modular offices, telephone networks, information technology equipment and systems, air conditioning equipment, reproduction and printing equipment, and motor vehicles.

  • Data Processing Equipment means any equipment, computer hardware, or computer software (and the lease or licensing agreements related thereto) other than Personal Computers, owned or leased by the Failed Bank at Bank Closing, which is, was, or could have been used by the Failed Bank in connection with data processing activities.

  • Special purpose equipment means equipment which is used only for research, medical, scientific, or other technical activities. Examples of special purpose equipment include microscopes, x-ray machines, surgical instruments, and spectrometers.

  • Infrastructure Improvements means a street, road, sidewalk, parking facility, pedestrian mall, alley, bridge, sewer, sewage treatment plant, property designed to reduce, eliminate, or prevent the spread of identified soil or groundwater contamination, drainage system, waterway, waterline, water storage facility, rail line, utility line or pipeline, transit-oriented development, transit-oriented property, or other similar or related structure or improvement, together with necessary easements for the structure or improvement, owned or used by a public agency or functionally connected to similar or supporting property owned or used by a public agency, or designed and dedicated to use by, for the benefit of, or for the protection of the health, welfare, or safety of the public generally, whether or not used by a single business entity, provided that any road, street, or bridge shall be continuously open to public access and that other property shall be located in public easements or rights-of-way and sized to accommodate reasonably foreseeable development of eligible property in adjoining areas. Infrastructure improvements also include 1 or more of the following whether publicly or privately owned or operated or located on public or private property:

  • private road means a road (not being a public road) which is either constructed by the Company in accordance with its proposals as approved by the Minister pursuant to Clause 7 or agreed by the parties to be a private road for the purpose of this Agreement;

  • Mobility enhancing equipment means equipment, other than durable medical equipment or a motor vehicle or equipment on a motor vehicle normally provided by a motor vehicle manufacturer, dispensed pursuant to a prescription, including repair or replacement parts for that equipment, that is all of the following:

  • Infrastructure improvement means permanent infrastructure that is essential for the public health and safety or that:

  • Farm equipment means equipment used directly for farming

  • Private entity means any natural person, corporation, general partnership, limited liability company, limited partnership, joint venture, business trust, public benefit corporation, nonprofit entity, or other business entity.

  • Protective equipment means an item:

  • Manufactured home park means any tract of land upon which three or more manufactured or mobile homes used for habitation are parked, either free of charge or for revenue purposes, and includes any roadway, building, structure, vehicle, or enclosure used or intended for use as a part of the facilities of the park.   • Motorboat means the same as that term is defined in Section 73-18-2.

  • Private Improvements means the improvements to be constructed on the Property that are not Public Improvements.

  • Mobile equipment means any of the following types of land vehicles, including any attached machinery or equipment:

  • Exhibition Centre means the centre named in the Application Form or such other venue as may be selected by the Organisers under clause 4.

  • Disposal site means that portion of a land disposal facility that is used for disposal of waste. It consists of disposal units and a buffer zone.

  • School equipment means a durable school-owned machine, equipment, or tool used by a student as part of an activity, course, or program in a secondary school and includes a saw or 3D printer. “School equipment” includes a saw or 3D printer.

  • private land means land other than unallocated State land.

  • Capital Equipment means machinery and equipment purchased or leased, and used in this state by the purchaser or lessee primarily for manufacturing, fabricating, mining, or refining tangible personal property to be sold ultimately at retail if the machinery and equipment are essential to the integrated production process of manufacturing, fabricating, mining, or refining. Capital equipment also includes machinery and equipment used primarily to electronically transmit results retrieved by a customer of an online computerized data retrieval system.
