  • Access agrees that it has no right or license outside the Field of Use and agrees that it will not use Interleukin Technology outside the Field of Use.

  • If Interleukin chooses not to bring an action against such third party for infringement of Interleukin Technology then, upon the consent of Interleukin, Access shall have the right, but not the obligation to take such action in Access’s name, and in the name of Interleukin.
