Fairness Hearing definition

Fairness Hearing means the hearing at or after which the Court will make a final decision whether to approve this Agreement as fair, reasonable and adequate.
Fairness Hearing means a hearing on the settlement proposed in this Settlement Agreement held by the Court to determine whether the proposed settlement is fair, reasonable, and adequate, and whether it should be finally approved by the Court.
Fairness Hearing means the hearing scheduled by the Court to consider (a) any objections from Class Members to the Settlement Agreement, (b) Class Counsel’s petition for Attorneys’ Fees and Costs and Class Representatives’ Compensation, and (c) whether to finally approve the Settlement under Fed. R. Civ. P. 23.

Examples of Fairness Hearing in a sentence

  • After the Bar Date, in accordance with the schedule set by the Court in the Preliminary Approval Order and in advance of the Fairness Hearing, Class Counsel shall file supporting documents and materials for Final Approval of the Settlement (“Final Approval Motion”).

  • An Objector who wishes to appear at the Fairness Hearing must state his or her intention to do so in writing on his or her Objection at the time he or she submits her written Objection.

  • The Parties may file with the Court written responses to any filed Objections no later than three (3) days before the Fairness Hearing.

  • Settlement Class Members who wish to present objections to the Settlement or the Agreement at the Fairness Hearing must first do so in writing (“Objection”).

  • The Notice will include a description of the claims and this Agreement, an estimate of each Settlement Class Member’s Individual Settlement Amount, and details regarding the opportunity to receive a Settlement Check and the opportunity to object or opt out, and/or appear at the Fairness Hearing.


More Definitions of Fairness Hearing

Fairness Hearing means the hearing at which the Court orders final approval of the Settlement.
Fairness Hearing means the hearing before the Court relating to the Motion for Final Approval.
Fairness Hearing or “Final Approval Hearing” means the final hearing to be conducted by the Court, on notice to the Settlement Class, to consider approval of the Settlement and Class Counsel’s motion for approval of attorneys’ fees and reimbursement of costs and expenses.
