Delta Facility means the facility described under "Business--Power Generation--The West--Facility Descriptions--Delta Facility" in the Offering Memorandum.

  • Subject to the provisions of this Agreement, including Section 4.3, Contractor acknowledges that Owner, other contractors and other subcontractors or other Persons may be working at or near the Site during the performance of this Agreement, that the Site is near the location of the Mirant Delta Facility which may be operating during the performance of Work at the Site and the Work or use by Contractor of certain facilities may be interfered with as a result of such concurrent activities.
