Construction of a new pipeline definition

Construction of a new pipeline means the installation of pipeline that will serve as a loop or extension to an existing pipeline or as an independent or stand-alone pipeline, any of which will be placed in service for the first time by an utility who filed a Form PHMSA F-7100.1-1 for the calendar year preceding the year in which construction takes place. An utility commencing service for the first time shall file a Proposed Installation Report with the Commission after receiving any necessary Certificate of Public Convenience and Necessity (CPCN) approval from the Commission and prior to the start of construction of the approved project. A CPCN is not required for an extension within a city, county, city and county, or territory within which an utility already lawfully provides service.
