Broadbase Products definition

Broadbase Products means all software owned by Broadbase, and such software, products and services offered to third parties by Broadbase as of the Effective Date, and any Updates or Upgrades to such software, products and services, and new software, products and services offered for sale by Broadbase, and all documentation associated therewith.
Broadbase Products means the Broadbase products specified in Exhibit B,

Examples of Broadbase Products in a sentence

  • Prices to the ASP Partner are calculated by applying the distribution discount, as defined on the following discount schedule, to the applicable product price (as defined in the then-current Broadbase Price List) for the country in which the Broadbase Product(s) will be installed and/or used.

  • Prices to ASP Partners for the Products are calculated by applying the distribution discount, as defined on Exhibit A, to the applicable product price, as defined in the then-current Broadbase Price List for the country in which the Broadbase Product(s) will be installed and/or used.

  • In order to enable the ADP to effectively provide first level post-sales service and support for all the Broadbase Products distributed by ADP, ADP agrees to cause at least two of its employees to complete the Broadbase Implementation Certification within six months of the signing of this document.

  • ADP will not, and will require its customers to agree to refrain from, any and all export or re-export of any Broadbase Products (including documentation and other technical data) in violation of U.S. export laws.

  • Prices to ADPs for the Broadbase Products are defined in Exhibits A and B.

  • ADP will bring any claims or causes of action it may have in a separate action and waives any right it may have to offset, setoff or withhold payment for the Broadbase Products and delivered by Broadbase.

  • ADP shall have the right to use the Broadbase Products to demonstrate Derivative Offering (i) on ADP's premises, (ii) at tradeshows, or at any function where ADP is demonstrating its core product and (iii) at a prospective End User's site provided that all copies of the Broadbase Products are removed within 5 days of when they are installed and provided further that ADP shall be responsible for protecting the confidentiality of the Broadbase Products while on the prospective End User's site.

  • Although Broadbase may publish suggested wholesale or retail prices, these are suggestions only and ADP will be entirely free to determine the actual prices at which the Broadbase Products will be licensed to its customers.

  • Tobacco products means cigars, cigarettes, cheroots, stogies, periques, granulated, plug cut, crimp cut, ready rubbed, and other smoking tobacco, snuff, snuff flour, moist snuff, cavendish, ping and twist tobacco, fine-cut and other chewing tobaccos, shorts, refuse scraps, clippings, cuttings and sweepings of tobacco, and other kinds and forms of tobacco, prepared in such manner as to be suitable for chewing or smoking in a pipe or otherwise, or both for chewing and smoking.

  • Hemp products means all products made from industrial hemp,

  • Software Products and “Software” are interchangeable and mean software, computer source codes and other computer programs.

  • the Products means all products and associated documentation to be supplied under this Contract;

  • Steel Products means products rolled, formed, shaped, drawn, extruded, forged, cast, fabricated or otherwise similarly processed, or processed by a combination of two or more or such operations, from steel made by the open heath, basic oxygen, electric furnace, Bessemer or other steel making process.   • Tobacco product means any substance containing tobacco leaf, including but not limited to, cigarettes, cigars, pipe tobacco, hookah tobacco, snuff, chewing tobacco, dipping tobacco, bidis, blunts, clove cigarettes, or any other preparation of tobacco; and any product or formulation of matter containing biologically active amounts of nicotine that is manufactured, sold, offered for sale, or otherwise distributed with the expectation that the product or matter will be introduced into the human body by inhalation; but does not include any cessation product specifically approved by the U.S. Food and Drug Administration for use in treating nicotine or tobacco dependence.

  • New Products means any product which is not an Enhanced Product or Existing Product but which is substantially similar to an of this Agreement, "New Product" or "New Products" shall mean any product which is not an Enhanced Product or 2 Existing Product but which is substantially similar to an Existing Product with respect to design and function and possesses reasonable performance improvements. If Company desires to purchase an Enhanced or New Product(s) from Supplier, Company shall so notify Supplier and provide Supplier the opportunity to manufacture such Enhanced or New Product(s), subject to the following conditions and procedures.

  • Business Products means all products and service offerings of the Business that are or have been, in the two year period prior to the date hereof, made or are currently intended to be made commercially available or otherwise provided or distributed, or under development primarily for the Business, by, for or on behalf of Seller or any of its Affiliates.

  • Refined Products means gasoline, diesel fuel, jet fuel, asphalt and asphalt products, and other refined products of crude oil.

  • Software Product means any COTS which you propose to provide pursuant to the contract.

  • Existing Products Tangible Products and intangible licensed Products which exist prior to the commencement of work under the Contract. Contractor retains the burden of proving that a particular product was existing before commencement of the Project. .

  • End Products as used in this clause, means those articles, materials, and supplies to be acquired for public use under this contract.

  • Tobacco product manufacturer means an entity that after the date of enactment of this act directly (and not exclusively through any affiliate) meets 1 or more of the following:

  • Manufactured end product means any end product in product and service codes (PSCs) 1000-9999, except—

  • Finished Products means the fully assembled and shrink-wrapped Licensed Products, each including a Game Cartridge, Game Cartridge label and Printed Materials.

  • Nicotine product means a product that contains nicotine and is not any of the following:

  • Commercial Software means Software developed or regularly used that: (i) has been sold, leased, or licensed to the general public; (ii) has been offered for sale, lease, or license to the general public; (iii) has not been offered, sold, leased, or licensed to the public but will be available for commercial sale, lease, or license in time to satisfy the delivery requirements of this Contract; or (iv) satisfies a criterion expressed in (i), (ii), or (iii) above and would require only minor modifications to meet the requirements of this Contract.

  • Cannabis products means cannabis that has undergone a process whereby the plant material has been transformed into a concentrate, including, but not limited to, concentrated cannabis, or an edible or topical product containing cannabis or concentrated cannabis and other ingredients.

  • Product means any deliverable under the Contract, which may include commodities, services, technology or software.

  • Additional Products means products, services and applications that are not part of the Services but that may be accessible, via the Admin Console or otherwise, for use with the Services.
