Average Income Test definition

Average Income Test pursuant to which "Low-Income" is defined as 80% of Area Median Gross Income, the Minimum Amount is 40% of the Units in the Project, and the average of the imputed income limitations of the Low-Income Units shall not exceed 60% of Area Median Gross Income.
Average Income Test means: At least 40 percent or more of the total residential units in each IRS project, as defined by the IRS and irrevocably elected by the Owner on line 8b of IRS form 8609 and, where applicable, described on the statement attached to form 8609, are both rent restricted and occupied by individuals whose income does not exceed the imputed income limitation designated by the taxpayer with respect to the respective unit as set out in 42(g)(1)(C). The imputed income limitation of any unit designated shall be 20 percent, 30 percent, 40 percent, 50 percent, 60 percent, 70 percent or 80 percent of the MTSP income limits (including adjustments for family size) as determined in accordance with Section 42 of the Code. The average of the imputed income limitations designated by the Owner with respect to the low-income units shall not exceed 60 percent of the MTSP income limits. Subject to any then-applicable guidance from either Treasury or the IRS and the Owner’s obligation to ensure compliance with the Code, the Owner may change from time to time the Owner’s designations.
Average Income Test. The Minimum Set-Aside Test as set forth in Section 42(g)(1)(C) of the Code (and any guidance provided by the IRS or the Authority with respect to such provision) whereby (i) at least forty percent (40%) of the Units in the Project are both rent restricted Units and occupied by tenants whose incomes do not exceed the imputed income limitations designated as applicable to the respective units (as adjusted for family size), (ii) the average of the imputed income limitations designated for all Units in the Project is not more than sixty percent (60%) of area median income, and (iii) the imputed income limitation designated for any unit in the Project is an increment of 10% and ranging between 20% and 80% of area median income.

  • Average Contribution Percentage means the average of the Contribution Percentages of the Eligible Participants in a group.

  • Average Net Assets means the average of all of the determinations of the Fund’s net asset value at the close of business on each business day during each month while this Contract is in effect. The fee is payable for each month within 15 days after the close of the month. The fees payable by the Fund to the Manager pursuant to this Section 3 will be reduced by any commissions, fees, brokerage or similar payments received by the Manager or any affiliated person of the Manager in connection with the purchase and sale of portfolio investments of the Fund, less any direct expenses approved by the Trustees incurred by the Manager or any affiliated person of the Manager in connection with obtaining such payments. In the event that expenses of the Fund for any fiscal year exceed the expense limitation on investment company expenses imposed by any statute or regulatory authority of any jurisdiction in which shares of the Fund are qualified for offer or sale, the compensation due the Manager for such fiscal year will be reduced by the amount of excess by a reduction or refund thereof. In the event that the expenses of the Fund exceed any expense limitation which the Manager may, by written notice to the Fund, voluntarily declare to be effective subject to such terms and conditions as the Manager may prescribe in such notice, the compensation due the Manager will be reduced, and if necessary, the Manager will assume expenses of the Fund, to the extent required by the terms and conditions of such expense limitation. If the Manager serves for less than the whole of a month, the foregoing compensation will be prorated.

  • Weighted Average Life Test means a test that is satisfied at any such time if the Weighted Average Life as calculated on the date of determination is less than or equal to 5.5 years.

  • Cash Flow Leverage Ratio means as of the last day of any calendar quarter the ratio of the Total Funded Debt as of such day to Adjusted EBITDA for the four calendar quarters then ended.

  • Class C Coverage Tests means the Class C Interest Coverage Test and the Class C Par Value Test.

  • Senior Net Leverage Ratio means, as of any date of determination, the ratio of (a) Senior Indebtedness on such date to (b) Consolidated Adjusted EBITDA for the period of four consecutive fiscal quarters of the Borrower ended on or prior to such time (taken as one accounting period) in which financial statements for each quarter or fiscal year in such period have been or were required to be delivered pursuant to Section 5.01(a) or (b) without giving effect to any grace period applicable thereto.

  • Weighted Average SOFR means the arithmetic mean of SOFR in effect for each Business Day during the relevant Interest Period, calculated by multiplying the relevant SOFR by the number of calendar days such SOFR is in effect, determining the sum of such products and dividing such sum by the number of calendar days in the relevant Interest Period, provided however that during a Suspension Period, the SOFR for each day during that Suspension Period will be the value for the Business Day immediately prior to the first day of such Suspension Period. For purposes of this provision “Suspension Period” is the number of Business Days prior to the end of the relevant Interest Period as specified in the applicable pricing supplement.
