ACC Approval definition

ACC Approval means a final and non-appealable order of the ACC, acceptable in all respects ***, which approves the Program. “Adjusted Hourly Customer Specific Baseline (“CSB”)” means the adjusted customer specific baseline, expressed in kilowatts, that is derived by multiplying the Unadjusted Hourly CSB by the Adjustment Ratio, in accordance with the example set forth in Appendix H.

ACC Approval means receipt of a determination from the ACC in form and substance satisfactory to TEP in its sole discretion that the terms and conditions of this Agreement are just and reasonable.

Examples of ACC Approval in a sentence

  • Each Party’s obligations under this Agreement, including without limitation APS’ obligation for the payment of any Monthly Capacity Payment and Monthly Energy Usage Payment, are expressly conditioned upon ACC Approval of the Program that is acceptable in all respects ***.

  • Where ACC Approval, Price or Cover is Uncertain If prior to the commencement of a Service, the Provider is uncertain whether or not: a particular person or Claimant is eligible for the Service; or a person is a Claimant; or a price has been agreed for the Service; or the services required for the Claimant are within the scope of the Services that can be provided under this Agreement then the Provider will immediately request a written determination of the issue from ACC.

  • APS will provide Seller with Notice of ACC Approval within five (5) Business Days after it occurs.

  • Promptly after the completion of the Construction Documents, Lessor shall submit the same to any and all Architectural Control Committees or similar entities as may be required by any applicable private covenants or similar non-governmental instruments which may be binding on the Land for review and approval by such entities (the "ACC Approval").

  • All Regulatory Approvals required to consummate the Transaction have been issued, including the AZDHS Approval and the ACC Approval.
