WAIVER/ENFORCEABILITY. In the event any part of this Agreement shall be held invalid or unenforceable the remaining part of this Rental Agreement shall be in full force and effect as though any invalid or unenforceable part or parts were not written into this Agreement. No waiver by Owner of any provisions hereof shall be deemed a waiver of any other provision hereof or of any subsequent default or breach by Occupant of the same or any other provision.
WAIVER/ENFORCEABILITY. WAIVER/ENFORCEABILITY. The waiver of a breach of any term or condition of this Agreement will not constitute the waiver of any other breach of the same or any other term. To be enforceable, a waiver must be in writing signed by a duly authorized representative of the waiving Party. The unenforceability of a provision of this Agreement or portion thereof will not affect the enforceability of any other provision of this Agreement or portion thereof.
WAIVER/ENFORCEABILITY. No delay in enforcing our rights will affect your obligations under this Agreement. If we waive any of the provisions of this Agreement, such waiver will apply only on that occasion and is not sufficient to modify the terms and conditions of this Agreement. If there is a conflict between this Agreement and Applicable Law, this Agreement will be considered changed to the extent necessary to comply with Applicable Law. Except as described in the arbitration provision, found in Section 0.XX of this Agreement, if any provision of this Agreement is deemed to be invalid, illegal or otherwise unenforceable, that provision may continue to be enforceable to the extent permitted by the court, and the remainder of that provision will no longer be considered part of this Agreement. All other provisions of this Agreement will remain in full force and effect.

WAIVER/ENFORCEABILITY. The failure of either party at any time to require performance by the other party of any provision hereof shall in no way affect the right of that party thereafter to enforce the same, nor shall it affect any other party's right to enforce the same, or to enforce any of the other provisions of this Agreement; nor shall the waiver by either party of the breach of any provision hereof be taken or held to be a waiver of any subsequent breach of such provision or as a waiver of the provision itself. Any waiver must be in writing and signed by the party to be charged with such waiver.
WAIVER/ENFORCEABILITY. Optm’s failure to enforce any provision of this Agreement is not a waiver of its right to do so later.
