Title, or Interest. It is agreed that this Fund is a Trust created pursuant to Section 302(c)(5) of the “Labor Management Relations Act of 1947,” as amended, and is intended to be in compliance with applicable provisions of the Internal Revenue Code and of the Act. The Title to all property in said Fund shall be vested in and remain exclusively in the Trustees of the Fund; no Employers, Employees, nor the Union, nor the Association, nor any person claiming by, through or under any of them, shall have any right, title or interest in, or to the Fund, or any part thereof, except such rights as conferred by the terms of the Trust Agreement.

  • Penalty Interest (1) If the loan is overdue or not used for the purpose specified in the contract, from the date of overdue or misappropriation, the penalty interest shall be calculated and collected according to the penalty interest rate specified in this paragraph for the overdue or misappropriated part until the principal and interest are paid off.   • Partnership Interest Except as provided in this Agreement and the Transferor Partnership Agreement, no right (contingent or otherwise) to purchase or acquire the Transferor Partnership Interests held by such Transferor Partner is authorized or outstanding.
