The Artist. All decoration in a tomb required the abilities of a craftsman experienced in the techniques of drawing/painting/sculpting and since he is a vital element in this process, his role cannot be ignored. The role of the ‘artist’ can be comprehended as an anonymous enabler and purveyor of accurate representation; he thus assumes a central albeit undefined position in the realization of the tomb-owner’s posthumous existence/state of being. The system of representation however was influenced by a convention as to how the visual depiction had to be executed. The artist was there to ensure that what was depicted was recognizable, and was repeated, such that reality was codified by integrating function and position into a single motif109. The Artist. (1) guarantees, absolutely and unconditionally, the full performance by (the "Furnishing Party") of all of the Furnishing Party's obligations under the Agreement; (2) agrees to indemnify and hold RISING STAR harmless from any loss, damage, liability or expense (including but not limited to attorneys' fees and legal expenses) which arise from any failure by the Furnishing Party to fulfill the Furnishing Party's obligations under the Agreement, or which are incurred by RISING STAR in the enforcement of RISING STAR's rights under this guaranty; and (3) shall notify RISING STAR promptly in writing if the Furnishing Party shall cease to be entitled to Artist's recording services.

  • Other Controller Audit Any other Controller may audit SAP’s control environment and security practices relevant to Personal Data processed by SAP in line with Section 5.1 only if any of the cases set out in Section 5.1 applies to such other Controller. Such audit must be undertaken through and by Customer as set out in Section 5.1 unless the audit must be undertaken by the other Controller itself under Data Protection Law. If several Controllers whose Personal Data is processed by SAP on the basis of the Agreement require an audit, Customer shall use all reasonable means to combine the audits and to avoid multiple audits.

  • Analytics 1.1. IFS may track and analyze the usage of the IFS Offering for purposes of determining usage made of the IFS Offering, for the purposes of security, to assist customers, and for improving the Software and Services and the user experience in using such Software and Services. For example, IFS may use this information to help customers derive more value from the Software and Services, to understand and analyze trends, or to track which features are used most often in order to improve the Software and Services. IFS may share anonymous usage data with its service providers for the purpose of helping in such tracking, analysis and improvements. Additionally, IFS may share such anonymous usage data on an aggregate basis in the normal course of operating their business; for example, IFS may share information publicly to show trends about the general use of its software and services.
