Submission, Creation of Board. If a grievance is not settled at Step 3, the grieving Party (The Union or the Employer) may submit the matter to Arbitration for final settlement. It shall do so by notifying the other Party of the submission, together with the name of its nominee to the Arbitration Board, within ten (10) days of the final date at Step 3. The other Party shall respond within five (5) days of the receipt of the submission, indicating its nominee. The two (2) nominees, within ten (10) days of the appointment of the second, shall choose a Chair. Where there is failure to appoint a nominee or to agree on a Chair within five (5) days of the final date for the respective appointment, either Party may request the Director of the Collective Agreement Arbitration Bureau to make the appointment.

Submission, Creation of Board. The Board of Arbitration shall consist of three members: one to be selected by the Employer, one to be selected by the Union and a third mutually acceptable person who shall act as Chairman, to be chose by the two persons thus selected. In the event that the Employer and the Union are unable to agree upon the selection of the third member of the board, the Director of the Collective Agreement Arbitration Bureau shall be requested to appoint such member.

  • Decision of Board ‌ The decision of the majority shall be the decision of the Board. Where there is no majority decision, the decision of the Chair shall be the decision of the Board. The decision of the Arbitration Board shall be final, binding, and enforceable on the parties.
