Special maternity leave. Special maternity leave applies to employees who have a pregnancy-related illness or whose pregnancy has ended other than by the birth of a living child within 28 weeks before the expected date of birth. Such employees may apply for unpaid leave. The maximum period of unpaid leave is the period specified in the medical certificate that is provided as part of the employee’s application for special maternity leave. However, the maximum period cannot exceed 52 weeks (see Clause 77.9).
