Solvency Certifications. If requested by the Lender, the Borrower shall deliver to the Lender satisfactory evidence that no (1) petition in bankruptcy, voluntary or otherwise, (2) assignment for the benefit of creditors, (3) petition seeking reorganization or arrangement under bankruptcy laws of the United States or of any state, or (4) other action brought under any bankruptcy laws, is pending against the Borrower. The Lender may request such a certification at any time during the Loan term.

Solvency Certifications. Bank reserves the right to require Borrower to provide evidence satisfactory to Bank that (i) the financial condition of Borrower shall not have changed materially and adversely from that set forth in their most recent respective financial statements supplied to Bank and (ii) no bankruptcy, reorganization, arrangement, readjustment of debt or insolvency proceeding shall have been threatened or commenced by or against Borrower or consented to or acquiesced in by Borrower, nor shall any judgment in excess of the Threshold Amount have been entered against. Bank reserves the right to require, at any time and from time to time, updated financial statements relating to Borrower. The Borrower authorizes Bank to obtain a credit report on a semiannual basis.

The Department shall have the right to request such certifications at any time during the Loan term.
Solvency Certifications. If requested by the County or the Department, the Recipient shall deliver to the Department and the County a certificate stating that no (1) petition in bankruptcy, voluntary or otherwise, (2) assignment for the benefit of creditors, (3) petition seeking reorganization or arrangement under bankruptcy laws of the United States or of any state, or (4) other action brought under any bankruptcy laws, is pending against the Recipient. The Department or the County may request such a certification at any time during the County ReGrant term.
