Solicitation Exceptions. For the avoidance of doubt, newspaper, periodical or Internet-based listings of employment opportunities by a Party shall not be considered direct or indirect solicitation of an employee, consultant, former employee or former consultant of the other Party or Affiliate. However, such Party shall continue to be precluded from engaging or otherwise using a Party’s and Affiliate’s employee, former employee, consultant or former consultant as set forth in this Section 6.6.

Solicitation Exceptions. 3.1 Offerors are cautioned to limit exceptions, conditions and limitations to the provisions of this RFP, as they may be determined to be so fundamental as to cause rejection of the offer for not responding to the requirements of the RFP. 3.2 Any and all Exceptions must be explicitly, fully and separately stated in the offer by completing Attachment V – Solicitation Exceptions, setting forth at a minimum the specific reasons for each exception so that it can be fully considered and, if appropriate, evaluated by The State.
