Common use of Safety Release Clause in Contracts

Safety Release. A. An employee who is required by the City to work sixteen (16) or more hours in any twenty-four (24) hour work day, and who is scheduled to work a shift in the next twenty-four (24) hour work day, from the start of the sixteen (16) hours, shall be guaranteed at least eight (8) hours off before being required to return to active duty status. Any portion of the eight (8) hours that overlaps with the beginning of the employee’s next shift will be considered paid leave time and there will be no deductions made from the employee’s leave accruals. If employees are directed to work their next scheduled shift, they shall be paid at the rate of time and one half (1 ½ ) for such portion of the shift which falls within the eight (8) hours of time off. B. Prior to working sixteen (16) or more hours in any twenty-four (24) hour work day, the employee shall make the on-duty or on-call shift Sergeant aware that the employee believes their current work assignment may result in the employee working sixteen (16) or more hours in the twenty-four (24) hour work day.
