Rights to Injunctive Relief. Both parties acknowledge that remedies at law may be inadequate to provide full compensation in the event of a material breach relating to either party’s obligations, representations, and warranties hereunder, and the non-breaching party will therefore be entitled to seek injunctive relief in the event of any such material breach.

Recognizing and acknowledging that any use or disclosure of the EDI Software by Licensee or Licensee Personnel in a manner inconsistent with the provisions of this Agreement may cause Licensor irreparable damage for which other remedies may be inadequate, Licensee agrees that Licensor shall have the right to petition for injunctive or other equitable relief from a court of competent jurisdiction as may be necessary and appropriate to prevent any unauthorized use or disclosure by Licensee or Licensee Personnel of any such information and that, in connection therewith, Licensee shall not oppose such injunction on the grounds that an adequate remedy is available at law.

You acknowledge that remedies at law may be inadequate to provide Adaptive BC Solutions, if an aggrieved party, with full compensation in the event of your breach, and that Adaptive BC Solutions shall be entitled to seek injunctive relief from a court of competent jurisdiction in the event of any such breach. Such injunction shall be in addition to, and not in lieu of other remedies available at law or in equity. You expressly agree that you shall not seek bond in connection with the issuance of any such injunction.
