Adequate Remedy Sample Clauses

Adequate Remedy. The Company and the Executive recognize that each party will have no adequate remedy at law for breach by the other of any of the agreements contained herein and, in the event of any such breach, the Company and the Executive hereby agree and consent that the other shall be entitled to a decree of specific performance, mandamus or other appropriate remedy to enforce performance of this Agreement.

Adequate Remedy. The Parties agree that any breach of either of the Parties’ obligations regarding confidentiality may result in irreparable injury for which there is no adequate remedy at law. Therefore, in the event of any breach or threatened breach of a Party’s obligations regarding the other Party’s confidentiality, the aggrieved Party will be entitled to seek injunctive relief, in addition to any other remedies to which it may be entitled.
Adequate Remedy. Grower acknowledges that any misuse or infringement of Red Tomato’s rights in the Licensed Marks may cause Red Tomato irreparable harm for which damages would not be an adequate remedy. Xxxxxx agrees that Red Tomato is entitled to obtain injunctive relief to restrain any such misuse or infringement.
Adequate Remedy. You specifically acknowledge and agree that a breach of Sections 8, 9 or 10 will result in the immediate discontinuance of any payments or benefits due pursuant to Section 2. Adequate Remedy. Each of Law Debenture, RTL Shareholder SVC, RTP and RTL hereby acknowledges and agrees with each other that damages would not be an adequate remedy for the breach of any provision of this Agreement and, accordingly, each shall be entitled to the remedies of injunction, specific performance and other equitable remedy for any such threatened or actual breach.

Accordingly, except as provided for by the Act and this Agreement, neither Executive nor the Company will be permitted to pursue court action regarding claims that are subject to arbitration.
