Relationship to Loan Agreement. The obligations and liabilities of the Owner according to this Deed shall be the same as its and the Borrower’s obligations and liabilities stated in the Loan Agreement. Consequently, this Deed shall be read together with the Loan Agreement but in case of any conflict between this Deed and the Loan Agreement, the provisions of the Loan Agreement shall prevail.

Relationship to Loan Agreement. CoastFed's remedies under this Accounts Agreement and the Loan Agreement are cumulative. If any provision of this Accounts Agreement modifies or conflicts with any provision of the Loan Agreement, that provision in either agreement that gives greater rights and remedies to CoastFed shall control. All capitalized terms used herein, which are not defined herein, shall have the meanings ascribed to them in the Loan Agreement.

  • Termination of Original Agreement Each Party agrees that the Original Agreement is hereby terminated as of the Effective Date and shall be of no further force or effect and, for the avoidance of doubt, no provisions of the Original Agreement survive such termination.
