Common use of REDUCTION OF STAFF Clause in Contracts

REDUCTION OF STAFF. A. When by reason of decreased enrollment of pupils, return to duty of regular teachers after leaves of absence, or by reason of suspension of schools or territorial changes affecting the District or for financial reasons, the Employer decides that it will be necessary to reduce the number of Teachers, it may make a reasonable reduction. In making such reduction, the Employer shall proceed to suspend contracts in accordance with the recommendation of the Superintendent who shall, within each certification/licensure affected, give preference to Teachers on continuing contracts. Prior to proceeding with an anticipated staff reduction, the Association President shall be notified by the Superintendent of the Board's intent to consider a staff reduction. A meeting shall be held between representatives of the Board and representatives of the Association to review the appropriate data indicating a need for a reduction in staff. The parties shall discuss why the reduction is necessary, what areas of certification/licensure may be affected, the possible extent of the anticipated reduction and the possible effects of the reduction.
