Purpose of Deposit. The Deposit is taken for the following purposes:

The Depositor undertakes to fully comply with sales policies of the Deposit Receiver at the time of entering into this Agreement as well as the entire terms and conditions of the Sale Contract provided by the Deposit Receiver.

The deposit by the County of the moneys into the respective Escrow Fund shall constitute an irrevocable deposit thereof for the uses and purposes specified in this Agreement and in the provisions of the 2003B Bonds Indenture or the Group Bonds Indenture, as applicable, and the respective series of Prior Bonds expressly referred to herein, and such moneys and Escrowed Securities, together with all interest thereon, shall be held and applied solely for such uses and purposes. Such moneys and Escrowed Securities, along with the proceeds of investment thereof, shall be held by the Escrow Agent separate and apart from all other funds and shall not be commingled with other moneys for any purpose.

Within sixty (60) days after expiration of the term of this Lease, as such term might be extended from time to time, Landlord shall refund the security deposit, if any, less any reduction therein because of default on the part of Tenant.

The deposit by the District of the Escrow Deposit in the Escrow Fund shall constitute an irrevocable deposit thereof for the uses and purposes specified in this Agreement and in the provisions of Resolution expressly referred to herein, and such moneys and all interest thereon shall be held in trust and applied solely for such uses and purposes. The Escrow Deposit, along with the proceeds of investment thereof, shall be held by the Escrow Agent separate and apart from all other funds and shall not be commingled with other moneys for any purpose.
