Pricing Discretion. Local pricing can vary from the Nominal Fee depending on mobile operator billing requirements, local market pricing practices, local legislation, local currency differences, and other factors. Apps Club may therefore vary the Nominal Fee to maximize gross receipts in its reasonable discretion. If Content Provider should become dissatisfied with Apps Club’s pricing practices its sole remedy and recourse shall be to remove its Content from the Program.

Pricing Discretion. Opera may vary the Fee to maximize gross receipts in light of local market conditions as follows: (i) for Content distributed within North American and Western Europe, Opera may vary the retail price by up to 25% to match mobile carrier billing points, or for time-limited promotions; (ii) for Content distributed outside of North America and Western Europe, Opera may vary the Fee as determined by Opera in its reasonable discretion.
Pricing Discretion. For the avoidance of doubt, nothing in this clause (A) shall prevent the Third Party Distributor from being free unilaterally to set its selling price for the Combination Product to any customer.
