Preparation and Production of Settlement Class List. BPPR or its agent shall compile the Class List, which shall consist of a list of all Settlement Class Members and provide the Class List to the Settlement Administrator within 21 days after the Preliminary Approval Order. The Class List shall include the total amount of Class Fees for each Settlement Class Member, whether the Settlement Class Member is a Current Accountholder with BPPR, as well as the current or last known postal addresses and email addresses (if available) in BPPR’s possession for the Settlement Class Members. The Settlement Administrator shall use this information for the sole purpose of identifying the addresses for the Settlement Class Members, and shall promptly and securely destroy the information after it is no longer needed for that purpose. Within 21 calendar days after the Preliminary Approval Order, BPPR will also provide an anonymized version of the Class List to Class Counsel for Class Counsel’s validation purposes, which will not include any personal identifying information related to Class Members.

The Settlement Administrator shall use this information for the sole purpose of identifying the current physical addresses and/or email addresses for the Settlement Class Members. Within twenty-one (21) calendar days after the Preliminary Approval Order, BANA will also provide the Class List to Class Counsel for Class Counsel’s validation purposes. However, the Class List provided to Class Counsel will not include any personal identifying information related to Class Members. Class Counsel shall have fourteen (14) calendar days therefrom to raise any objections to the Class List.

  • Certification of Settlement Class Promptly after execution of the Settlement Agreement, Class Counsel will ask the Court to issue an order certifying the Settlement Class for settlement purposes only. Xxxxx agrees not to object to this request without waiver of its right to contest certification or the merits of the Lawsuit if the settlement does not receive final approval or the Effective Date (defined in paragraph 14 below) does not occur.
