Performance of Network Elements. 9.1 Access to Network Elements provided by ALLTEL to MCIW will meet applicable regulatory performance standards and be at least equal in quality and performance as that which ALLTEL provides to itself. MCIW may at its option request, and ALLTEL will provide, to the extent technically feasible, access to Network Elements that is lesser quality than ALLTEL provides to itself and such service will be requested pursuant to the Bona Fide Request process.
Performance of Network Elements. 7.1 Access to Network Elements provided by Windstream to XxXxxx will meet applicable regulatory performance standards and be at least equal in quality and performance as that which Windstream provides to itself. XxXxxx may request, and Windstream will provide, to the extent technically feasible, access to Network Elements that is lesser quality than Windstream provides to itself and such service will be requested pursuant to the Bona Fide Request process.

Alliance Connect may request, and Windstream will provide, to the extent technically feasible, access to Network Elements that is lesser quality than Windstream provides to itself and such service will be requested pursuant to the Bona Fide Request process.

LSP-PGNAPS may request, and ALLTEL will provide, to the extent technically feasible, access to Network Elements that is lesser quality than ALLTEL provides to itself and such service will be requested pursuant to the Bona Fide Request process.
Performance of Network Elements. 9.1 Access to Network Elements provided by ALLTEL to TCG will meet applicable regulatory performance standards and be at least equal in quality and performance as that which ALLTEL provides to itself. TCG may at its option request, and ALLTEL will provide, to the extent technically feasible, access to Network Elements that is lesser quality than ALLTEL provides to itself and such service will be requested pursuant to the Bona Fide Request process.
Performance of Network Elements. Nothing in this Agreement will limit either Party's ability to modify its network through the incorporation of new equipment, new software or otherwise. Each Party will provide the other Party written notice of any such upgrades in its network which will materially impact the other Party's service consistent with the timelines established by the FCC in the Second Report and Order, CC Docket 96-98. CLEC will be solely responsible, at its own expense, for the overall design of its telecommunications services and for any redesigning or rearrangement of its telecommunications; services which may be required because of changes in 325 facilities, operations or procedure of NEVADA, minimum network protection criteria, or operating or maintenance characteristics of the facilities.
Performance of Network Elements. Nothing in this Agreement will limit either Party's ability to modify its network through the incorporation of new equipment, new software or otherwise.
