Operator’s Qualifications. (a) The Operator (including any Operator who is not a Participant) must be duly authorized to conduct business in the jurisdiction in which the Property is located and must hold all necessary licences and authorities to act as Operator. Any Participant may request the Operator to provide evidence of such authorization, licences and authorities. (b) Generation represents and warrants to Stillwater that as at the Effective Date it is duly authorized to conduct business in the jurisdiction in which the Property is located and holds all necessary licences and authorities to act as Operator. Should the circumstance arise where Stillwater elects to be Operator, Stillwater represents and warrants to Generation that as at the time it commences acting as Operator it will be duly authorized to conduct business in the jurisdiction in which the Property is located and holds all necessary licences and authorities to act as Operator. (c) A Participant who is entitled to be the Operator under this Agreement may, provided all Participants agree, appoint an Affiliate to be the Operator. As a condition to such appointment, such Affiliate must comply with Section 3.12(b).
Operator’s Qualifications. The Operator (including any Operator who is not a Partner) must have sufficient experience in the mining industry to fulfill its role as herein contemplated, be duly authorised to conduct business in the Province of British Columbia and must hold all necessary licenses and authorities to act as Operator. Operator’s Qualifications. The equipment will be operated only by trained, qualified personnel and Lessee will not make any repairs, adjustments or alterations without Lessor's express written consent. Operator’s Qualifications. ▇▇▇▇▇▇’▇ personnel who perform operations in Avista’s substations or on line facilities at a Point of Delivery are required to meet the applicable operating requirements of Cheney. Such personnel shall be familiar with the operation of all substation or line facilities and equipment that concerns his or her position and be fully aware of the hazards connected therewith, or have passed a journeyman’s examination for the particular branch of the electrical trades with which he or she may be connected.

  • STAFF QUALIFICATIONS a) CONTRACTOR shall ensure that all individuals employed, contracted, and/or otherwise hired by CONTRACTOR to provide classroom and/or individualized instruction or related services hold a license, certificate, permit, or other document equivalent to that which staff in a public school are required to hold in the service rendered consistent with Education Code section 56366.1(n)(1) and are qualified pursuant to Title 5 of the California Code of Regulations sections 3064 and 3065. b) Only those NPS/A located outside of California that employ staff that hold a current valid credential or license to render special education and related services as required by that state shall be eligible to be certified. NPA/NPS staff shall be required to hold credentials and licenses within the state where they are providing services regardless of where the agency is located. c) When CONTRACTOR is a nonpublic school, NPS, an appropriately qualified person shall serve as curricular and instructional leader, and be able to provide leadership, oversight and professional development. The administrator of the NPS holds or is in the process of obtaining one of the following: (A) An administrative credential granted by an accredited postsecondary educational institution and two years of experience with pupils with disabilities.

  • Personnel Qualifications Contractor shall assign properly qualified and experienced personnel to the program contemplated under this Agreement, and Contractor shall use reasonable efforts to retain such personnel on Customer’s program for the duration of such program.

  • Professional Qualifications It shall be a condition of continued professional employment that employees must apply for enrolment in their appropriate professional licensing body by the thirtieth day of continuous service.

  • Contractor Qualifications Contractor warrants that Contractor has the necessary licenses, experience and technical skills to provide services under this Contract.

  • Required Qualifications At all times during the term of the Contract, Vendor shall have available, under direct employment and supervision and/or subcontract agreement fully incorporating the terms and conditions of the Contract Documents, the required qualified and properly licensed (as applicable) personnel to properly fulfill all the terms and conditions of the Contract.
