Open procedure. Tender procedures are open whenever all interested economic operators may submit a tender after publication of an tender notice. The tender notice shall specify at least the rules governing the lodging/submission and presentation of tenders, the exclusion, selection and award criteria and set out the technical specifications.
Open procedure. In the Open Procedure all Applicants are eligible to tender for the project. The envisaged number of tenderers in a Restricted Procedure is between 5 and a higher number (as specified in the Contract Notice – normally 8). Where a candidate, having qualified for the short-list, withdraws prior to the completion of the Tender Process, or is subsequently found to have provided inaccurate information sufficient to justify exclusion (at any stage after the short-list is formed), the competition will proceed with the remaining number of candidates. Applicants who failed to be short-listed will not be subsequently added to the list. Where a firm is excluded from the competition at any stage (for any reason) and that exclusion reduces the number to less than 3, the procurement process may be abandoned and re-advertised.
