Obstruction of Roads. The excavation for pipe works shall be open cutting unless the permission of the Independent Engineer for the ground to be tunnelled is obtained in writing. Where sewers have to be constructed along narrow passages, the Independent Engineer may order the excavation to the made partly in tunnel and in cases the excavated soil shall be brought back later on for refilling the trenches or tunnel.

Obstruction of Roads. The Concessionaire shall not occupy or obstruct by his operation more than one half of the width of any road or street and if insufficient space shall then be left for public and private transit, he shall remove the materials excavated and bring them back again when the trench is required to be refilled. The Concessionaire shall obtain the consent of the Independent Engineer in writing before closing any road to vehicular traffic and the foot walks must be clear at all times.
Obstruction of Roads. The Tenant shall not permit any vehicles owned or operated by or under the control of the Tenant to cause an obstruction on any parking areas or roadways on the Lands and the Tenant shall use its best endeavors to ensure that all persons doing business with the Tenant and their servants and workers shall not permit any vehicles to cause such obstruction as aforesaid. The Tenant shall also use its best endeavors to ensure that vehicles owned or operated by or under the control of the Tenant, its employees or persons doing business with the Tenant shall observe all regulations and instructions made or given by the Landlord with regard to the parking of vehicles on areas provided for the parking of vehicles on the Lands.

  • Construction of the Improvements Once development of the Property has commenced, the construction of the Improvements shall be pursued with due diligence and continuity, in a good and workmanlike manner, and in accordance with sound building and engineering practices, all applicable governmental requirements, and the Development Plan. Borrower shall not permit cessation of work for a period in excess of thirty (30) days during any period of time during which development on the Property is scheduled to be performed without the prior written consent of Lender, which may be given or withheld in Lender’s sole discretion, except for delays due to strikes, riots, acts of God, war, unavailability of labor or materials, governmental laws, regulations or restrictions and Borrower shall promptly notify Lender of any such delays; provided, however, that in no event shall work cease for a period in excess of sixty (60) days regardless of the cause. Borrower shall cause all materials supplied for, or intended to be utilized in, the development of any part of the Property, but not affixed to or incorporated into the Property, to be stored on the Property or at such other location as may be approved by Lender in writing, with adequate safeguards, as required by Lender, to prevent loss, theft, damage, or commingling with other materials or projects.

  • Construction of the Project The Allottee has seen the proposed layout plan, specifications, amenities and facilities of the Apartment/ Plot and accepted the floor plan, payment plan and the specification, amenities and facilities annexed along with this Agreement which has been approved by the competent authority, as represented by the Promoter. The Promoter shall develop the Project in accordance with the said layout plans, floor plans and specifications, amenities and facilities. Subject to the terms in this Agreement, the Promoter undertakes to strictly abide by such plans approved by the competent authorities and shall also strictly abide by the bye-laws, FAR, and density norms and provisions prescribed by the relevant building bye-laws and shall not have an option to make any variation/ alteration/ modification in such plans, other than in the manner provided under the Act, and breach of this term by the Promoter shall constitute a material breach of this Agreement.

  • Production of Witnesses; Records; Cooperation (a) After the Effective Time, except in the case of a Dispute between Parent and SpinCo, or any members of their respective Groups, each Party shall use its commercially reasonable efforts to make available to the other Party, upon written request, the former, current and future directors, officers, employees, other personnel and agents of the members of its respective Group as witnesses and any books, records or other documents within its control or which it otherwise has the ability to make available without undue burden, to the extent that any such person (giving consideration to business demands of such directors, officers, employees, other personnel and agents) or books, records or other documents may reasonably be required in connection with any Action in which the requesting Party (or member of its Group) may from time to time be involved, regardless of whether such Action is a matter with respect to which indemnification may be sought hereunder. The requesting Party shall bear all costs and expenses in connection therewith.
