Nuclear Material. The Nuclear Material is free and clear of any Lien in favor of any Person claiming by, through or under the Lessee or any Affiliate thereof, other than Permitted Liens. No default or event which with the giving of notice or lapse of time would constitute a default has occurred and is continuing under any Nuclear Material Contract.

The release of any radioactive, toxic or explosive material from any nuclear weapon; or 3.
