Notification Initiated by the Department. If the Department believes any Noncompliance Event has occurred, or receives notice from any Patron that any Noncompliance Event has occurred, for which the Department has not received notification from the Development Entity in accordance with Section 11.2(a)(i), the Department may deliver to the Development Entity a written notice setting forth the Department’s determination of the occurrence of a Noncompliance Event, the relevant Noncompliance Start Date, any applicable Cure Period and the number of Noncompliance Points to be assessed with respect thereto in accordance with Schedule 7 (Noncompliance Points Table).

Notification Initiated by the Department. ‌ If the Department believes there has occurred any Noncompliance specified in Section 4 of Division II, as it may be revised from time to time, the Department may deliver to Developer a notice of determination setting forth the Noncompliance, the applicable Cure Period and the Noncompliance Points to be assessed with respect thereto. The Department may deliver the notice of determination via the electronic data base, and delivery shall be deemed given upon entry of the information into the electronic data base.

Notification Initiated by the Department. If the Department believes any Unavailability Event or Service Failure has occurred, or receives notice from any Patron that any Unavailability Event or Service Failure has occurred, for which the Department has not received notification from the Development Entity in accordance with Section 11.2(a), the Department may deliver to the Development Entity a written notice setting forth the Department’s determination of the occurrence of such Unavailability Event or Service Failure and the applicable Unavailability Penalty or Service Failure Penalty.

  • Emergency Escalation initiated by Registrars Registry Operator will maintain an emergency operations department prepared to handle emergency requests from registrars. In the event that a registrar is unable to conduct EPP transactions with the registry for the TLD because of a fault with the Registry Service and is unable to either contact (through ICANN mandated methods of communication) the Registry Operator, or the Registry Operator is unable or unwilling to address the fault, the registrar may initiate an emergency escalation to the emergency operations department of ICANN. ICANN then may initiate an emergency escalation with the Registry Operator as explained above.
