Non-Drought Situation. When a Drought Situation does not exist, (A) from Stampede Reservoir, Non-Firm M&I Credit Water shall Spill first, and Fish Credit Water and Joint Program Fish Credit Water shall Spill second pursuant to Section 5.C.2, and (B) from all other reservoirs, Fish Credit Water, Joint Program Fish Credit Water, and Non-Firm M&I Credit Water shall Spill proportionately pursuant to Section 5.C.2, except that additional Non-Firm M&I Credit Water identified in Section 8.F.4(a) shall Spill after Fish Credit Water and Joint Program Fish Credit Water.

Non-Drought Situation. Whenever a Drought Situation does not exist, then from July 1 through December 31, Power Company shall have the first right to Accumulate Firm M&I Credit Water and Power Company Emergency Drought Supply in Stampede Reservoir and such Accumulation may result in Displacement of Fish Credit Water, Joint Program Fish Credit Water and Fish Water in Stampede Reservoir to the extent necessary to Accumulate Firm M&I Credit Water and Power Company Emergency Drought Supply.‌

  • Emergency Situation In the event of an emergency situation beyond our reasonable control, such as an "act of God," war, fire, or natural disaster, services involving your account could be available only in a modified or reduced form or could be entirely unavailable. Unless expressly prohibited by applicable law, you agree that we will have no liability to you for such modification, reduction, or unavailability of services caused by an emergency situation.

  • Special Situations The parties recognize that under certain circumstances a Change in Control may occur under conditions which make it inappropriate for Employee to receive the termination benefits or protection set forth in this Agreement. Therefore, in the event that a Change in Control occurs for any one of the following reasons, the provisions of Sections 2, 6 and 9 shall not apply:

  • Emergency Situations If the condition is an emergency, this will be communicated to the Contractor with the request that corrections are to be accomplished immediately. The Contractor shall respond to the notice in emergency situations within twenty-four hours. If the Contractor fails to respond within this time limit, the Owner may correct the defect and charge the Contractor for the Work. If it is determined the complaint is not the responsibility of the Contractor, the Contractor shall be promptly paid for the cost of the corrective work. The Contractor shall give notice in writing to the Owner when corrections have been completed.

  • Summer Session A. All ASEs employed in the Summer Session shall receive the same general range adjustment as ASEs received in the preceding Fall term.

  • New Member Orientation The Employer will notify the Union of any newly represented temporary employees. The Union will be given the opportunity to have a Union representative speak with the newly represented temporary employees for not more than thirty (30) minutes to provide information about the Union and this Agreement.

  • Teaching Staff Assigned to More Than One Building Each Educator who is assigned to more than one building will be evaluated by the appropriate administrator where the individual is assigned most of the time. The principal of each building in which the Educator serves must review and sign the evaluation, and may add written comments. In cases where there is no predominate assignment, the superintendent will determine who the primary evaluator will be.
