New Monitoring Xxxxx. Prior to recordation of the Parcel Map, the Parties shall negotiate in good faith to determine mutually acceptable locations (and easement dimensions, if applicable) for the installation of two new groundwater monitoring xxxxx (the “New Monitoring Xxxxx”), which locations may or may not be on the CSU Property. The New Monitoring Xxxxx will be substantially similar in quality and type to the Monitoring Xxxxx as they exist as of the E fective Date. CSU shall install the New Monitoring Xxxxx in such mutually acceptable locations at its sole cost and expense, after PUD has first approved in writing CSU’s application for installation ofthe New Monitoring Xxxxx in accordance with PUD’s standard application process and PUD’s normal regulations and after CSU has first obtained all other required Approvals. The City shall promptly cause the easement for the existing Monitoring Xxxxx to be extinguished after CSU has completed the installation of the New Monitoring Xxxxx and has made the New Monitoring Xxxxx operational for regular use, with appropriate access rights in the City’s favor.
