Common use of Medical Opinions Clause in Contracts

Medical Opinions. The Employer may require that an employee submit to a medical examination at the expense of the Employer, where for reasons of health, an employee is frequently absent or unable to perform his or her duties. Additionally, the employee may be held out of service until the examination has been completed and a medical certificate from a Licensed Practitioner indicating that the employee is fit to perform regular duties is provided to the Employer. In certain circumstances the Employer may require an employee to attend the Employer’s Licensed Practitioner for a medical opinion, but those circumstances would have to be unusual. The employee shall be compensated for all lost time if the employee is found to be fit. Such requests shall not be made in an unreasonable or discriminatory manner.
