Common use of Long Term Illness Clause in Contracts

Long Term Illness. Should a full-time employee have a single illness exceeding ninety (90) days duration, and all sick leave credits have been used, the benefits of the Long Term Disability Plan outlined in Article 26.01(d) of this Agreement shall apply. An employee accepted on the Long Term Disability shall continue to receive all fringe benefits (except pension) s/he is entitled to as set forth in this Agreement for a maximum period of twenty-four (24) months. During that twenty-four month period the employee may, if s/he is able to do so, return to his/her position. Alternatively, where that employee’s position no longer exists or where that employee may not be able to return to his/her position then after twelve (12) months of becoming eligible for Long Term Disability and within ninety (90) days thereof, the employee may request his/her name to be placed on the Recall List. If an employee receives benefits under the Disability Insurance Plan (LTD), the College shall pay to the employee the difference between the benefit and the employee’s full salary for as long as the accumulated sick leave credits permit. In such cases, the charge against the employee’s sick leave credits shall be in the same proportion that the College’s payment bears to the full salary of the employee computed at the end of each month to the nearest half-day.
