Liability of User. 8. The USER shall be liable for all costs of excess and preventative maintenance and restoration and all other expenses incurred pursuant to this Agreement, including but not limited to costs related to inspections, roadway condition surveys and administration costs. The USER agrees that the POSTING AUTHORITY is under no obligation to prove that the USER caused the damage. The USER agrees to pay all invoices promptly. The USER'S liability shall not be limited to the total amount of security provided. The USER shall be responsible for third party vehicle and property claims that arise as a result of the USER activities.
Liability of User. 9.1 GSK shall not be liable for any damages to either person or property sustained by User or its personnel or by any third party arising in any way; The User’s use, operation, or occupancy of GSK or any portion thereof; or the sale, distributions, or use of any product that is produced at GSK. This includes any items or products stored in cold, dry, or frozen storage, and User should take care to obtain insurance that covers any potential associated loses. GSK does not use a backup power generator and User should remain attentive to the potential for power outages and how those may impact their operations or storage.

Liability of User. 8. The user and the Municipality retain the right to terminate their future obligation under this Agreement at any time by submitting a written notice of intent to terminate. As soon as possible after receipt of such notice, the Municipality and the user’s representatives shall inspect the Municipal highway(s) and appurtenances. The Municipal highway(s) and appurtenances if Paragraph 6, Option B was elected, shall be restored to level consistent with that agreed to in Paragraph 3 (above). Restoration shall be performed by the party(ies) agreed to in Paragraph 6 (above). Thereupon this Agreement shall be terminated and of no further force or effect and all security shall be released.

The borrower states that he/she has, and is presumed to have, all the information and skills necessary for careful and normal use of the equipment; it is his/her responsibility to supplement his/her knowledge if necessary. Similarly, he/she states that he/she has the authorization, licenses and legal capacity to have or use the equipment. The borrower is the sole custodian of the Item during the time of allowed use, he/she undertakes as such to exercise effective and exclusive control of the Item. The borrower is therefore the sole person responsible, apart from REMS, for any damage that the equipment could cause to the borrower or a third party. The borrower expressly recognizes that he/she is the custodian of the equipment requested for the full duration of the time of allowed use and, should the case arise, beyond this time, until the return of the equipment to REMS is accomplished. Consequently, REMS assumes no liability during the time of allowed use of the equipment borrowed, in particular regarding its incorrect, imprudent or illegal use.
