Liability for Vehicles. Town shall be fully responsible for any damage to any vehicle rented under this Agreement however caused; provided, however, in the case of a breakdown of any vehicle, if Town shall provide compelling evidence that the breakdown was due to improper maintenance by District and/or normal wear and tear of the vehicle, Town shall not be responsible for the resulting damage and/or required repair.

Liability for Vehicles remains the responsibility of the Supplier until Delivery, regardless of whether any sub-contractors are nominated by the Customer and Vehicles are transferred to the nominated sub-contractor for works. This is unless agreed otherwise in writing between the Supplier and any sub- contractor, but at no point will the Customer have any liability for Vehicles that have not been Delivered.

Liability for Vehicles. If the services provided under this Agreement require that any Manager Personnel move or drive any vehicle owned or leased by Owner or by any third party, then, notwithstanding any other provision of this Agreement to the contrary, Owner releases Manager from any liability, and agrees to indemnify Manager and Manager Indemnitees with respect to, and to hold each of them harmless from and against, any and all Claims, resulting from moving the vehicle.

In the event Included Timber to which Forest Service holds title is damaged, Contracting Officer shall make an appraisal to determine for each species the difference between the appraised unit value of Included Timber immediately prior to the value loss and the appraised unit value of timber after the loss. Current Contract Rates in effect at the time of the value loss shall be adjusted by differences to become the redetermined rates. There shall be no obligation for Forest Service to supply, or for Purchaser to accept and pay for, other timber in lieu of that destroyed or damaged. This Subsection shall not be construed to relieve either party of liability for negligence.

  • Liability for loss or damage Subject to the provisions of the Occupiers Liability Act 1957 and the Defective Premises Act 1972, we shall not in any circumstances incur any liability in respect of loss or damage to any person or property or otherwise, unless the loss or damage was caused by our negligence.

  • LIABILITY FOR ERRORS AND OMISSIONS If the Financial Institution makes an error or omission in recording or processing any Transaction, the Financial Institution is only liable for the amount of the error or omission if You have not caused or contributed to the error or omission in any way, have complied with this Agreement and the Account Agreement, and have given written notice to Us within the time provided in the Account Agreement, and to the extent the liability is not otherwise excluded by this Agreement or the Account Agreement. If You have given such notice, the Financial Institution’s maximum liability is limited to the amount of the error or omission. In no event will We be liable for any delay, inconvenience, cost, loss, or damage (whether direct, indirect, special, exemplary, or consequential) whatsoever caused by, or arising from, any such error or omission.
