Common use of Initiation of Review by City Council Clause in Contracts

Initiation of Review by City Council. In addition to the annual review, the City Council may at any time initiate a review of this Agreement by giving written notice to Developer. Within thirty (30) calendar days following receipt of the notice, Developer shall submit evidence to the City Council of Developer’s good faith compliance with this Agreement and the review and determination shall proceed in the same manner as provided for the annual review. The City Council shall initiate its review pursuant to this Section 10.D. only if it has probable cause to believe City’s general health, safety or welfare is at risk as a result of specific acts or failures to act by Developer.
