Immunity Not Waived. THE PARTIES EXPRESSLY AGREE THAT NO PROVISION OF THIS CONTRACT IS IN ANY WAY INTENDED TO CONSTITUTE A WAIVER BY DEPARTMENT OR THE STATE OF TEXAS OF ANY IMMUNITIES FROM SUIT OR FROM LIABILITY THAT DEPARTMENT OR THE STATE OF TEXAS MAY HAVE BY OPERATION OF LAW.
Immunity Not Waived. Nothing in this Agreement is intended, nor may it be deemed, to waive any governmental, official, or other immunity or defense of any of the Parties or their officers, employees, representatives, and agents as a result of the execution of this Agreement and the performance of the covenants contained herein.
Immunity Not Waived. The parties expressly agree that no provision of this Agreement is in any way intended to constitute a waiver by DSHS or the State of Texas of any immunities from suit or from liability that DSHS or the State of Texas may have by operation of law.
Immunity Not Waived. This Agreement is governmental in nature, for the benefit of the public, and is not intended to be for private profit or gain. Nothing contained herein, and none of the provisions of this Agreement shall be construed as a waiver of sovereign immunity. No party intends to waive its sovereign immunity by reason of this Agreement.

The Town does not intend to waive its sovereign immunity by reason of this Agreement; provided, however, that the Town acknowledges and agrees that by entering into this Agreement, governmental immunity shall not be a valid defense to a breach of contract claim brought hereunder.

Immunity Not Waived. Each party hereto expressly does not waive any immunity or other defenses to any civil claims by the execution of this Agreement. It is understood and agreed that, by executing this Agreement, no party waives, nor shall be deemed hereby to waive, any immunity or defense which otherwise is available in claims arising out of or in connection with, any activity conducted pursuant to this Agreement.
Immunity Not Waived. This Agreement is governmental in nature, for the benefit of the public. No waiver of any such immunities, defenses, rights or actions shall be implied or otherwise deemed to exist by reason of UWCFA’s entry into this Agreement.

The City’s participation in this Agreement is governmental in nature, for the benefit of the public, and is not to be for private profit or gain; that any amounts charged by the City in connection with loans hereunder are intended to reflect as closely as possible the City’s actual costs under the program. The City does not intend to waive its sovereign immunity by reason of this Agreement and; that nothing herein shall be construed as a delegation of the City’s legislative authority or as a delegation of the City’s legislative and governmental authority of the City.
