Customer remains legally responsible for the assessment of the lawfulness of the collection, processing and use of personal data as well as for the safeguarding of the rights of affected third parties and with regard to claims asserted by such third parties. Customer shall ensure that any personal data stored in the Information System is lawfully processed.

Further Duties of Customer. 2.1 The Customer remains legally responsible for the assessment of the lawfulness of the collection, cross-border transfer processing and use of Personal Data, as well as for the safeguarding of the rights of affected third parties and the data subjects; and with regard to claims asserted by such third parties and data subjects; and the Customer shall ensure that any Personal Data stored in the Information Systems is lawfully processed and transferred.
