Product Availability Under no circumstances shall Company be responsible to Representative or anyone else for its failure to fill accepted orders, or for its delay in filling accepted orders, when such failure or delay is due to strike, accident, labor trouble, acts of nature, freight embargo, war, civil disturbance, vendor problems or any cause beyond Company's reasonable control.

Average Daily Balance To get the "Average Daily Balance" of Purchases, we take the beginning balance of your Credit Card account each day, add any new Purchases, and subtract any Cash Advances, payments, or other credits which were applied to Purchases, unpaid FINANCE CHARGES, late charges, membership fees, and other fees. If you paid the Purchases balance in full by the Payment Due Date in the previous billing cycle, in the current billing cycle we will credit payments otherwise applicable to Purchases based on our allocation method as of the first day of the current billing cycle. These computations give us the Purchases daily balance. To get the "Average Daily Balance" of Cash Advances, we take the beginning balance each day, add any new Cash Advances, and subtract any Purchases, payments, or other credits which were applied to Cash Advances, unpaid FINANCE CHARGES, late charges, membership fees, and other fees. This gives us the Cash Advances daily balance. hours per week An employee hired prior to September 1, 1997, who as of that date is scheduled to work a normal work week of less than forty (40) hours per week, shall not be scheduled to work a normal work week of forty (40) hours per week while he/she remains in his/her current position, unless agreed to by the employee.
Full-Time Nurse A nurse who is hired on a permanent basis and who normally works seven (7) hours per day on a thirty-five (35) hour week, normally Monday to Friday unless specifically hired to work an alternate schedule.

You should consult with an academic advisor each semester to ensure you maintain appropriate degree progress and are fulfilling all requirements for the agreement. Course sequencing below assumes a fall start date. If starting the program during any other term, please consult with your academic advisor. *NOTE: Required coursework for the associate degree and credentials required for admission to the BS Respiratory Therapy (Online) program are not outlined here. Measurement Should the State terminate this contract as herein provided, no fees other than fees due and payable at the time of termination shall thereafter be paid to the Engineer. In determining the value of the work performed by the Engineer prior to termination, the State shall be the sole judge. Compensation for work at termination will be based on a percentage of the work completed at that time. Should the State terminate this contract under paragraph (4) or (5) above, the Engineer shall not incur costs during the thirty-day notice period in excess of the amount incurred during the preceding thirty days.
