Effect of Failure to Timely Transfer Assets. Notwithstanding any provision to the contrary, the terms of this paragraph shall apply in the event the City fails to liquidate (or have liquidated) all assets currently invested in the City of Hapeville Defined Benefit Pension Plan trust fund and transfer (or have transferred) at least 85% of such liquidated assets to the GMEBS Retirement Trust by June 5, 2020. In such event, the City, and not GMEBS, will be responsible for processing and distributing all July 1, 2020, benefit payments under the Plan to Participants (and their beneficiaries) in pay status as of such date. Thereafter, the City shall remain responsible for processing benefit payments under the Plan until the first day of the first month that begins at least 20 days after the date on which at least 85% of the liquidated assets describe in this paragraph 15(b)(vi) have been transferred to GMEBS. GMEBS shall otherwise be responsible for administering the Plan effective June 2, 2020, including but not limited to processing Retirement benefit applications and requests for death benefits and determining the amounts of any benefits newly payable under the Plan, and will notify the City of the amounts of any benefits which become newly payable after June 2, 2020, and until the date on which GMEBS assumes responsibility for processing benefit payments. The City shall process payments of any benefits which become newly payable after June 2, 2020, until the date GMEBS assumes responsibility for processing benefit payments (i.e., the first day of the first month that begins at least 20 days after the date on which at least 85% of the liquidated assets describe in this paragraph 15(b)(vi) have been transferred to GMEBS) in accordance with the information provided by GMEBS.

You may ask for copies of the documents that we used in our investigation.

  • LIABILITY FOR FAILURE TO COMPLETE TRANSACTIONS If We do not properly complete a transaction to or from Your Account according to this Agreement, We will be liable for Your losses or damages. However, We will not be liable if: (a) Your Account does not contain enough available funds to make the transaction through no fault of Ours; (b) the ATM where You are making the transfer does not have enough cash; (c) the terminal was not working properly and You knew about the breakdown when You started the transaction; (d) circumstances beyond Our control prevent the transaction despite reasonable precautions that We have taken; (e) Your Card is retrieved or retained by an ATM;

  • Our Liability for Failure to Complete Transactions If we do not properly complete a transaction from your Card on time or in the correct amount according to our Agreement with you, we will be liable for your losses or damages.
