Design-Builder’s Right to Stop Work. Design-Builder may, in addition to any other rights afforded under the Contract Documents or at law, stop work upon the Owner’s failure to pay amounts approved by Owner’s Representative pursuant paragraph 7(a)(i) above. Should the event set forth in Article 15.c.i above occur, Design-Builder has the right to provide the School Board with written notice that Design-Builder will stop work unless said event is cured within fifteen (15) days from the School Board’s receipt of Design-Builder’s notice. If the School Board does not cure the problem within such fifteen (15) day period, Design-Builder may stop work. In such case, Design-Builder shall be entitled to make a claim for adjustment to the Contract Price and Contract Time(s) to the extent it has been adversely impacted by such stoppage.

  • Owner’s Right to Stop Work The Owner reserves the right, for itself and for any designated Construction Inspector retained by Owner, upon observation of apparent nonconforming Work, to immediately stop the affected Work. Landlord shall have the right to enter the Outside Areas during normal business hours for purposes of (i) inspecting the exterior of the Building and the Outside Areas; (ii) posting notices of nonresponsibility (and for such purposes Tenant shall provide Landlord at least thirty days’ prior written notice of any work to be performed on the Leased Premises); and (iii) supplying any services to be provided by Landlord. Any entry into the Leased Premises or the Outside Areas obtained by Landlord in accordance with this paragraph shall not under any circumstances be construed or deemed to be a forcible or unlawful entry into, or a detainer of, the Leased Premises, or an eviction, actual or constructive of Tenant from the Leased Premises or any portion thereof.

  • Right to Proceed The Sponsor acknowledges the rights of Holders to institute a Direct Action as set forth in Section 2.8(d) hereto.
